These Terms of Use (hereinafter the “Terms”) govern access to and use of the Benchmap mobile application (hereinafter the “Application”) available on iOS and Android, as well as the services offered by Lina BLIDI and Maxence WOLFF (hereinafter “Benchmap” or “we”).

Downloading and using the Application implies full and unconditional acceptance of these Terms.

User: any natural person who has downloaded the Application and uses the services offered.

User Account: personal space created by the User enabling access to the Application’s features.

Application: the Benchmap mobile application available on the iOS (App Store) and Android (Google Play Store) platforms.

Services: all features and content offered within the Application.

Content: texts, images, videos, data, saved places, comments, and any other element created or shared within the Application.

Stores: mobile application download platforms (Apple App Store and Google Play Store).

2.1 Download and installation

The Application is available for free download on:
• iOS: App Store
• Android: Google Play Store

Downloading and installing the Application may be subject to the respective Stores’ terms of use.

2.2 Access requirements

Access to the Application requires:
• A compatible mobile device (smartphone or tablet)
• An internet connection (Wi‑Fi or mobile data)
• An up-to-date operating system
• Acceptance of these Terms upon first use

2.3 Free of charge

The Application is entirely free. No subscription or in-app purchase is offered in the current version. If paid options are introduced in the future, they will be clearly indicated in the Application and managed by the Stores (Apple / Google).

2.4 Availability

Benchmap strives to keep the Application available 24/7. However, Benchmap reserves the right to temporarily interrupt access for technical maintenance, updates, or security reasons, without notice or compensation.

2.5 Updates

Benchmap reserves the right to modify or update the Application. Updates may be automatic or manual. Some may be mandatory to continue using the Application.

2.6 Changes to the Application

Benchmap reserves the right to add, modify, or remove features, or to permanently discontinue the Application.

3.1 Registration

The User must create an Account by providing: First name, Valid email address, Secure password.

3.2 Credential responsibility

The User is solely responsible for keeping their credentials confidential. In case of fraudulent use, contact: contact@benchmap.fr.

3.3 Accuracy of information

The User agrees to provide accurate information. Benchmap may suspend any account based on false information.

3.4 User profile

Customization is possible (photo, description). By default, contributions (benches, photos, comments) are public.

3.5 Account deletion

Deletion is possible via “Settings” > “Account” > “Delete my account” or by email. This results in the permanent loss of associated data, although bench locations may be retained in anonymized form.

4.1 Authorized use

It is prohibited to use the app for illegal purposes, to infringe intellectual property, to distribute unlawful content (racist, homophobic, etc.), to extract data, or to disrupt technical operations.

4.2 Features offered

Discovery via geolocation, listing of new benches, interactive map, favorite collections, photos, reviews, multi-criteria search, and community features.

4.3 Required permissions

• Location (GPS): REQUIRED for core features.
• Camera: For bench and profile photos.
• Photo library: To import images.
• Storage & Push Notifications.

4.4 Geolocation

Used to display nearby benches and to register benches. You may disable it, but this will significantly limit use of the Application.

Encouraged: authentic sharing, kindness, and valuing urban furniture. Prohibited: harassment, spam, false information, and endangering others’ privacy. Violations may lead to a warning, suspension, or permanent deletion.

5.1 Zero tolerance

Benchmap applies a zero-tolerance policy toward objectionable content and abusive behavior. Prohibited in particular: hateful content, harassment, threats, sexually explicit, violent, illegal, or misleading content, as well as any form of abuse toward another user.

5.2 Reporting and blocking

Each user may, directly from the Application, report objectionable content or a profile and block an abusive user. Blocking immediately hides the content of the person concerned. Reports are reviewed and objectionable content removed, with responsible accounts sanctioned (warning, suspension, or deletion), generally within 24 hours.

5.1 License granted to Benchmap

You grant Benchmap a worldwide, royalty-free, transferable license to use, modify, and distribute your content within the service and for its promotion.

5.2 Moderation and removal

Benchmap may moderate or remove any content that violates the Terms, without prior notice.

The Application and its content (code, design, logos) are the exclusive property of Benchmap. A personal, non-exclusive, revocable license is granted for strictly private use.

In accordance with the GDPR, Benchmap processes your account, location, content, and technical data for the operation of the service, its improvement, and security. Retention period: lifetime of the account (except legal obligations). You have rights of access, rectification, erasure, and objection via contact@benchmap.fr.

Benchmap is not liable for indirect damages, errors in data provided for informational purposes, technical bugs, or acts of third parties. The user is responsible for their device and connection.

Payments and subscriptions are managed by the Stores (Apple/Google). Cancellation must be done via your Store account settings. No pro-rata refunds are issued.

Governing law: French law. In the event of changes to the Terms, the User will be informed. For any questions: contact@benchmap.fr.
